Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Services offered by EPIC Livin Academy, LLC (“ELA,” “we,” “us,” or “our”). By purchasing, enrolling in, or using our Services, you agree to these Terms.
1. Scope of Policy
These Terms apply solely to Services provided by EPIC Livin Academy, LLC. They do not apply to Jennifer Knecht personally, her personal brand, or her professional role at Western States Lodging & Management.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction). By enrolling, you represent you are legally able to enter into this Agreement.
3. Offers & Promotions
Discounts and coupons may not be combined unless explicitly stated.
Offers valid only while supplies last and subject to change without notice.
Accounts not in good standing are ineligible for offers or bonuses.
4. Merchandise Purchases
Most merchandise is fulfilled by third parties.
No refunds for wrong size, address errors, buyer’s remorse, or unclaimed shipments.
Claims for misprinted/damaged items must be submitted within 30 days.
Gift card purchases are non-refundable.
5. Digital Products & Online Programs
All sales final. No refunds or early cancellations.
Programs grant time-limited, non-transferable access.
You may not resell, share, or redistribute materials.
Subscription cancellations effective end of current term; no prorations.
6. Live Events
Tickets are non-refundable and non-transferable.
Ticket Credits. With ≥15 days’ notice before event, you may request a credit equal to the ticket price (less fees) toward a future ELA program.
Change Fees. Transfers to another event incur a fee (25% of ticket or $500, whichever is less).
Hotel Packages. Non-refundable and non-transferable.
Recording Consent. Attendance = consent to use of your image, voice, and likeness for educational/promotional purposes.
Conduct. We may deny entry or remove participants for misconduct without refund.
7. Payment Terms
All fees must be paid in advance unless otherwise stated.
Payment plans are a commitment to the full amount.
Missed payments may result in suspension and forfeiture of access.
Chargebacks may result in immediate termination of Services.
You are responsible for applicable taxes.
8. Intellectual Property
All Services, content, and materials are owned by EPIC Livin Academy, LLC or its licensors.
You are granted a limited, non-transferable, revocable license for personal educational use only.
Unauthorized sharing or reproduction is prohibited.
9. Disclaimers
Educational Only. Services are not legal, financial, tax, or medical advice.
No Guarantee. Examples/testimonials are extraordinary stories, not promises. Results depend on your effort and responsibility.
As-Is Basis. Services are provided “as is” and “as available.”
10. Limitation of Liability
We are not liable for indirect, incidental, consequential, or special damages (including lost profits or data).
Our aggregate liability is limited to the greater of (a) the amount you paid in the past 12 months or (b) $200.
Jennifer Knecht has no personal liability under these Terms.
11. Indemnification
You agree to indemnify and hold harmless EPIC Livin Academy, LLC, its officers, employees, and affiliates from claims, losses, or damages arising from your use or breach.
12. Force Majeure
ELA is not liable for failure or delay caused by events beyond our control (natural disasters, pandemics, strikes, government orders, outages, etc.).
13. Governing Law
These Terms are governed by Utah law. Venue lies exclusively in the courts of Salt Lake County, Utah. Class action and jury trial waivers apply.
14. Entire Agreement & Changes
These Terms, together with our Privacy Policy and any program-specific terms, form the entire agreement. We may update these Terms at any time. Continued use = acceptance.
